Course Description

In the clinical justice system, therapist misconduct cases can be heard before three separate, yet equally important entities: the civil court system, which addresses malpractice cases, the BBS, which hears complaints against therapists' licenses, and the CAMFT ethics committee, which hears ethics complaints. Interested in hearing their stories? Then this is the workshop for you!
 
This workshop will provide a comprehensive overview of the civil litigation process (for malpractice lawsuits), the BBS complaint process, and the CAMFT ethics committee’s ethics complaint process. The workshop will also provide an overview of the categories of unprofessional conduct for which the BBS can take disciplinary action against therapists (listed in Business and Professions Code Section 4982) and discuss strategies for reducing liability risks. Additionally, the workshop will provide needed information about the processes for opting in and opting out of Medicare.

Educational Goals

Participants will be able to recognize different types of laws and ethics codes governing the practice of therapy. Participants will be able to differentiate between the civil litigation, BBS complaint, and ethics complaint processes. Participants will understand how to become Medicare providers and what it means to opt out of Medicare. 


Learning Objectives

At the conclusion of this presentation, participants will be able to:

  1. State the differences between laws and ethical rules, and how violating legal and ethical requirements may cause practitioners to face malpractice lawsuits, BBS complaints, and ethics complaints
  2. Identify at least 5 categories of unprofessional conduct for which the Board can suspend or revoke a therapist's license or take other disciplinary action against practitioners.
  3. State the protocols for enrolling in Medicare as well as the protocols for opting out of Medicare

Training Schedule and Attendance Requirements

This 6-CE training starts promptly at 9:00am and ends at 4:30pm. Please arrive at 8:30am to allow time for registration. The schedule includes time for lunch and breaks. You will need to be physically present for the entirety of the training, as confirmed by sign-in and sign-out sheets, in order to qualify for the CEs.

As a CAMFT staff attorney, Bradley J. Muldrow, Esq. takes member phone calls regarding law and ethics issues and contributes articles on those subjects to CAMFT's publication, the Therapist. Prior to joining CAMFT’s legal team, Brad worked on litigation and regulatory matters as an attorney for San Diego Gas & Electric Company.


Since becoming an attorney, Brad has given law and ethics presentations to attorneys and judges as a member of the J. Clifford Wallace Inn of Court. He has also served as a board member for the Earl B. Gilliam Bar Foundation, a San Diego-based nonprofit.

This course meets the qualifications for 6.0 hrs of law and ethics continuing education (CE) credit for LMFTs, LCSWs, LPCCs, and/or LEPs as required by the California Board of Behavioral Sciences
